CREATELINK.LINK — TERMS OF SERVICE

Effective Date: August 27, 2026

This Terms of Service agreement (the "Agreement") constitutes a legally binding contract between the operator of the website CreateLink.link (the "Platform", "Service", "We", "Us", "Our", or "Operator") and any individual or legal entity accessing, registering, or utilizing the Platform's URL redirection, analytics, and traffic-filtering infrastructure (the "User", "You", or "Your").

The Service is currently operated by an individual based in Ukraine. [If/when a legal entity (e.g., ФОП/LLC) is registered to operate the Service, this section will be updated to identify that entity, its registration number, and registered address.]

BY CHECKING THE CONSENT BOX, CREATING AN ACCOUNT, PURCHASING CREDITS, OR OTHERWISE UTILIZING THE INFRASTRUCTURE OF CREATELINK.LINK, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT AND OUR PRIVACY POLICY, INCORPORATED HEREIN BY REFERENCE.

1. SCOPE OF SERVICE AND USER RESPONSIBILITY

1.1. CreateLink.link operates exclusively as a technical SaaS provider, supplying self-service URL shortening, traffic routing, analytical dashboards, and automated bot-filtering utilities based on a pay-as-you-go credit architecture. 1.2. The Platform operates strictly on a passive technical transmission basis. All destination URLs, tracking domains, subdomains, and redirect configurations are generated, managed, and deployed entirely at the sole discretion and risk of the User. 1.3. We do not pre-screen, endorse, or assume ownership over content transmitted through User-generated links, but reserve the automated and manual monitoring rights described in Section 4. 1.4. Eligibility: The Service is intended solely for individuals who are at least 18 years old (or the age of legal majority in their jurisdiction) and for legal entities capable of entering into binding contracts. By using the Service, You represent that You meet this requirement.

2. ACCOUNT REGISTRATION AND CREDIT ARCHITECTURE

2.1. To access the Platform, Users must complete registration with a valid, verified email address and receive a unique User ID. You are solely responsible for maintaining the confidentiality of your credentials and for all activity occurring under your account. 2.2. The Platform operates on a non-expiring credit framework (1 Created Link = 1 Credit). 2.3. Financial Transactions & Non-Refundability: All payments for credit packages processed via our integrated third-party cryptocurrency processor (NOWPayments) are final, irreversible, and non-refundable, due to the immediate and digital nature of the provisioned infrastructure. The User waives any right to refunds, chargebacks, or transaction reversals to the maximum extent permitted by applicable law. 2.4. Anti-Money-Laundering (AML) Notice: We reserve the right to request additional verification, delay processing, or refuse/reverse a transaction where there is reasonable suspicion of money laundering, fraud, or use of stolen payment credentials, without liability to the User.

3. STRICT ACCEPTABLE USE POLICY (AUP) AND PROHIBITED ACTIVITIES

CreateLink.link is engineered solely for legitimate marketing optimization, data analytics, white-hat affiliate tracking, and origin-server protection. The User agrees that the Platform SHALL NOT be used, directly or indirectly, for any malicious, deceptive, or illegal activity, including but not limited to:

3.1. Phishing, Cyber-Attacks and Malicious Vectors: Deploying links that redirect to phishing pages, credential-harvesting pages, fake login/brand-impersonation pages, malware, ransomware, spyware, trojans, rootkits, exploit kits, or any other destructive payload. 3.2. Fraud and Impersonation: Facilitating financial scams, "get-rich-quick" or crypto-investment schemes (e.g., rug pulls), tech-support scams, deceptive giveaways, identity theft, or unauthorized impersonation of banks, brands, government bodies, or individuals. 3.3. Malicious Cloaking and Ad-Network Abuse: Using the redirect engine to deceive ad-network crawlers (Google, Meta, TikTok, etc.) by serving different content to reviewers than to real users (cloaking) in order to distribute prohibited or deceptive payloads. 3.4. Illegal Content Distribution: Routing traffic to material that violates applicable law, including non-consensual explicit media, child sexual abuse material (CSAM), unauthorized copyrighted material, or illegal substances/weapons. 3.5. Spam and Unsolicited Communications: Using links in unsolicited bulk email, SMS, or messaging campaigns that violate anti-spam laws (e.g., CAN-SPAM, GDPR/ePrivacy). 3.6. Any activity that could subject Us or Our infrastructure providers to blacklisting, legal liability, or law-enforcement action.

Violation of this Section is grounds for immediate termination under Section 4, without refund.

4. MONITORING, ABUSE REPORTS, AND TERMINATION RIGHTS

4.1. Automated Link Screening: Every destination URL is automatically screened at the time of link creation, and periodically re-screened thereafter, against third-party threat-intelligence databases (including but not limited to Google Safe Browsing, VirusTotal, and PhishTank) and internal heuristic traffic analyzers, in order to detect phishing, malware, and other abusive destinations. Screening is a fraud-prevention measure only and does not constitute a guarantee that any given link is safe; final responsibility for lawful use rests with the User under Section 1.2. 4.2. Abuse Reporting: Reports of suspected abuse may be submitted to info@createlink.link. We aim to review credible reports promptly. 4.3. Immediate Consequences of a Detected Violation: If automated screening, internal monitoring, or a credible third-party report identifies a link or account in breach of Section 3, We reserve the right to take any or all of the following actions immediately and without prior notice: a) Deactivate the specific offending link pending review; b) Instantly suspend or terminate the User's entire account; c) Deactivate, delete, and permanently disable all redirects/links associated with the account; d) Forfeit all remaining credits and account balance, with NO refund, credit, or compensation of any kind, regardless of the payment method used or credits' unused status; e) Report the activity to relevant law-enforcement, cybersecurity, or industry authorities where required or appropriate. The User expressly acknowledges and agrees, as a condition of using the Service, that a confirmed AUP violation results in permanent, non-refundable forfeiture of all account credits, in addition to any other remedies available to Us under this Agreement or applicable law. 4.4. Appeal Procedure: A User whose account or link has been suspended or terminated under this Section may submit a written appeal to info@createlink.link within fourteen (14) calendar days of the action, providing evidence that the flagged link or activity did not violate Section 3 (e.g., proof of a false-positive threat-database match, evidence of a compromised/hijacked destination now remediated, or other relevant documentation). We will review appeals in good faith and respond within a reasonable time. Submission of an appeal does not automatically reinstate the account or restore credits pending review, and Our decision on the appeal is final and at Our sole discretion. This appeal procedure does not apply to violations involving illegal content under Section 3.4, which are not eligible for reinstatement.

5. DISCLAIMER OF WARRANTIES & THIRD-PARTY INTEGRATIONS

5.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 5.2. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. The Platform relies on external infrastructure, including Cloudflare proxy protection and third-party security-reputation APIs. We are not liable for service degradation caused by these third parties. 5.3. Domain Blacklisting Disclaimer: We assume no liability for blacklisting, flagging, or blocking of tracking domains or destination URLs by third-party systems (e.g., Google Safe Browsing, Microsoft SmartScreen, Spamhaus, WOT). Maintaining domain reputation through lawful use is the User's sole responsibility.

6. LIMITATION OF LIABILITY AND INDEMNIFICATION

6.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATELINK.LINK, ITS DIRECTORS, EMPLOYEES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR AD-CAMPAIGN BUDGETS, ARISING FROM DOWNTIME, OUTAGES, TRAFFIC DROPS, OR DOMAIN DEACTIVATIONS. 6.2. Our total aggregate liability arising out of or relating to this Agreement shall not exceed the amount paid by the User to Us in the three (3) months preceding the claim. 6.3. Indemnification: The User agrees to defend, indemnify, and hold harmless CreateLink.link and its affiliates from claims, liabilities, losses, damages, costs, and legal fees arising from the User's traffic, links, or breach of this Agreement.

7. INTELLECTUAL PROPERTY / COPYRIGHT COMPLAINTS

7.1. If you believe a link on the Platform infringes your copyright or trademark, please send a notice to info@createlink.link including the infringing link, a description of the work, and your contact details. We will investigate and may disable the link in accordance with Section 4.

8. PRIVACY

8.1. Our collection and use of personal data (including email addresses, IP addresses, and analytics data) is governed by our separate Privacy Policy, available at createlink.link/privacy, which forms part of this Agreement.

9. GENERAL PROVISIONS

9.1. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict-of-law principles. Any dispute shall be subject to the exclusive jurisdiction of the courts of Ukraine. [Update this clause if the Service is later transferred to a legal entity registered in another jurisdiction.] 9.2. Severability: If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. 9.3. Entire Agreement: This Agreement, together with the Privacy Policy, constitutes the entire agreement between the parties regarding the Service. 9.4. Assignment: We may assign this Agreement in connection with a merger, acquisition, or sale of assets. Users may not assign their rights without Our prior written consent. 9.5. Force Majeure: We are not liable for any failure to perform due to causes beyond Our reasonable control (e.g., natural disaster, war, internet/infrastructure outages, governmental action). 9.6. Amendments: We may modify this Agreement at any time. Material changes will be reflected by an updated "Effective Date." Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. 9.7. Contact: Questions about this Agreement may be directed to info@createlink.link.

By checking the consent box during registration, You execute a digital signature confirming that You have read, understood, and agreed to be bound by this Agreement.
